Terms of use

About these terms

1. These terms are a legally binding agreement between you and MQBau Engineering of Australia ("MQBau", "we", "us", "our"), the business that makes MQBone. Wherever these terms protect MQBau, they also protect MQBau's owners, directors, employees, contractors and agents, and the MQBau and MQBone names and brands.
2. "MQBone" means the MQBone app on iPhone, iPad and Mac, its CarPlay and Siri features, ECU Controls and MQBpatch features in the app, Advanced Diagnostics, Tuner PINs, MQBadapter and its firmware updates, the tuner portal at portal.mqbone.app, the website at mqbone.app, and all related services, updates, content and documentation.
3. "MQBadapter" means MQBau's OBD-II adapter hardware, the firmware that runs on it, its case and anything supplied with it.
4. "Subscription" means an Advanced Diagnostics subscription (clause 8).
5. "Vehicle" means any vehicle you connect MQBone to or use MQBone on, and any engine, gearbox, controller, module, sensor, wiring or other part of it.
6. "Operation" means anything MQBone does to or with a Vehicle, including reading data, diagnostics, clearing fault codes, logging, coding, adaptations, basic settings, output tests, unlocking, flashing, recovery and ECU Controls.
7. "Modification" means any change to a Vehicle's software, calibration, coding, settings or behaviour, made with MQBone or because of it, including tunes, Tuner PIN flashes, ECU unlocking and MQBpatch features.
8. "Australian Consumer Law" means Schedule 2 to the Competition and Consumer Act 2010 (Cth), and "the law" includes any law that applies to you or your Vehicle.
9. Headings and examples are for convenience only. "Including" means "including without limitation".

Using MQBone means you agree to these terms

1. You agree to the version of these terms in force each time you use MQBone. Continuing to use MQBone after we change these terms means you accept the change (see clause 27).
2. If you use MQBone for a business or on behalf of anyone else, such as a workshop, a tuner or a vehicle's owner, you confirm that you're authorised to accept these terms for them, and "you" includes them. You're responsible for anyone who uses MQBone through your device or account.
3. Where you get the app through the App Store, Apple's standard terms for apps also apply. Apple isn't responsible for MQBone, its support or any claim about it.
4. It's your responsibility to read these terms, the help pages and every warning the app shows before you rely on MQBone.

Who may use MQBone

1. You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract.
2. You may only use MQBone on a Vehicle that you own, or whose owner has clearly authorised you to diagnose, modify or flash it. You're responsible for getting that authority, for keeping proof of it, and for any dispute about it.
3. You're responsible for having the knowledge, skill and equipment to carry out each Operation safely. If you aren't sure, don't start it. Ask us or a qualified professional first.

Your licence to use MQBone

1. We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use MQBone in line with these terms. You don't own MQBone. MQBau keeps all rights in MQBone and MQBpatch, including their software, protocols, designs, content, names and logos.
2. You must not copy, modify, reverse engineer, decompile, disassemble or extract MQBone or any part of it, or redistribute, sell, rent, lend or sublicense it, except where the law allows you to despite this clause.
3. You must not bypass, disable or interfere with activation, account checks, security features or limits in MQBone, or help anyone else to.

This website

1. mqbone.app describes MQBone. It has no sign-in and no account area. Your account, activations and purchases are in the app. Purchases made on this website go through portal.mqbone.app, where you sign in with Apple. Tuners also manage remote tunes there.
2. VIN activations and Subscriptions can be bought in the App Store version of the app, through Apple, or on this website or in the MQBone TestFlight beta, through a secure checkout run by Stripe (clause 6). MQBadapter is also sold on this website through Stripe (clause 12). When MQBadapter is out of stock, it can't be ordered.
3. Everything on this website, in the help pages, in our emails and in the community is general information, not advice about your Vehicle. You're responsible for checking that it applies to your Vehicle before you rely on it.

Buying activations and subscriptions

1. Two ways to buy. A VIN activation or a Subscription can be bought in the App Store version of the app through Apple, or on this website or in the MQBone TestFlight beta through Stripe. Either way you get the same activation or Subscription. The price can differ between them because the fees differ, and each price is shown before you pay. Prices are in US dollars, and your bank may charge currency conversion fees.
2. In the app. Where MQBone offers an in-app purchase, Apple takes the payment and Apple's own terms apply to that transaction. The prices and taxes Apple shows at the time of purchase are the ones that apply.
3. Refund requests for Apple charges go to Apple, through reportaproblem.apple.com, because Apple holds the payment.
4. A purchase can be left pending, for example when Ask to Buy needs approval or your bank asks for extra verification. Apple decides the outcome. If Apple approves it, the app completes the activation then.
5. If Apple took the payment but the activation wasn't granted, the app's activation sheet offers Retry Confirmation, and Restore Purchases re-checks what Apple holds for your Apple Account. See purchases that don't finish.
6. If the purchase went through but the activation isn't working, email support@mqb.au with the address you purchased with, rather than paying a second time. Please don't send card numbers.
7. On this website. The Buy buttons take you to portal.mqbone.app. There you sign in with Apple and, for an activation, enter the VIN. Stripe then takes the payment. The purchase is linked to the MQBone account of the Apple Account you signed in with, and an activation to the VIN you entered. It isn't linked to an email address. Sign in with the same Apple Account you use in the MQBone app, and check the VIN before you pay. If the purchase doesn't appear in the app, email support@mqb.au with your Stripe receipt.
8. In the MQBone TestFlight beta. The beta app sells through the same pages. The first time, you're asked to link the beta app to the Apple Account you sign in with, so the purchase works in both apps. One beta account links to one Apple Account. Linking again replaces the old link.
9. Refunds for website purchases, and for Stripe purchases made in the MQBone TestFlight beta, come to us, not Apple. Email us with your receipt. Apple's refund process doesn't apply to them, and your rights under the Australian Consumer Law (clause 23) apply as usual.
10. You're responsible for buying with the right account, for the right Vehicle, and for keeping your purchase records.

What a VIN activation covers

1. An activation is a one-time purchase for one Vehicle, identified by its VIN. It isn't a subscription and has no recurring fee. For that Vehicle's supported engine and gearbox controllers it covers recording new datalogs to CSV; calibration and full flashes, recovery and ECU unlocking, where the app supports them for your controller; and flashing a tune your tuner sends you with a Tuner PIN.
2. These don't need an activation: live data and Home widgets, fault codes and adaptations, ECU Controls, CarPlay, Siri, and importing, viewing and sharing logs. Starting a recording from CarPlay or Siri still needs the activation. Each additional Vehicle needs its own.
3. Activations are linked to your MQBone account, not to a device, so they work on your iPhone, iPad and Mac with the same Apple Account and can be restored after a reinstall. A different account needs its own activation for the same VIN. Data stored on your devices isn't part of an activation and isn't restored with it.
4. Deleting your account removes the activations held on it, and they aren't re-granted to a new account or a different Apple Account. Deletion isn't a refund. See deleting your account.
5. You're responsible for making sure an activation is for the correct VIN. An activation is an app feature, not a promise that any Operation will succeed on your Vehicle.

Advanced Diagnostics subscription

1. What it is. Advanced Diagnostics is a paid Subscription linked to your MQBone account. While it's active, you can use Advanced Diagnostics on any Vehicle you connect with that account. It isn't tied to one VIN and doesn't include a VIN activation.
2. Price. A Subscription costs US$50 a year when bought on this website through Stripe, or US$60 a year when bought in the app through the App Store. The price, and any tax, is shown before you pay.
3. Automatic renewal. A Subscription renews automatically each year, and you're charged the renewal price at the start of each new year, until you cancel. You're responsible for cancelling before the renewal date if you don't want to renew.
4. Cancelling in the app. Subscriptions bought through the App Store are managed by Apple. Cancel in your Apple Account's subscription settings at least 24 hours before the renewal date.
5. Cancelling on the website. Subscriptions bought on this website are billed by Stripe to the payment method you used. Cancel any time at portal.mqbone.app/manage, signed in with the same Apple Account, or by emailing support@mqb.au.
6. When cancellation takes effect. When you cancel, your Subscription stays active until the end of the year you've paid for, and then doesn't renew.
7. Price changes. We may change the Subscription price. For website Subscriptions we'll email you at least 30 days before a new price applies to your renewal, and you can cancel before then. Apple tells App Store subscribers about price changes under its own rules.
8. Refunds. Except where the law requires otherwise (clause 23), we don't refund part of a Subscription year, or a year you didn't use. Refunds for App Store Subscriptions are handled by Apple.
9. Separate purchases. A Subscription bought on the website and one bought in the app are separate. They don't combine or extend each other. You're responsible for not subscribing twice.
10. When it ends. If your Subscription ends or a renewal payment fails, Advanced Diagnostics stops working. Scan reports and module backups already saved on your devices stay there.
11. Coverage. Advanced Diagnostics needs an internet connection and your MQBone account. Which modules, values and functions are available depends on the Vehicle, its modules and their software, and on our diagnostic data, which we may add to, change or remove. A Subscription doesn't promise that any particular module, value or function will be available for your Vehicle.
12. Your responsibility. Coding, adaptations, basic settings, output tests and service functions change how a Vehicle's modules behave and can operate parts of the Vehicle. Using them is an Operation, covered by clauses 15 to 17, and the exclusions and indemnity in clauses 21 and 22 apply. Back up a module before you change it.

What an activation doesn't include

1. MQBadapter. MQBone needs MQBadapter to connect to a Vehicle. It's separate hardware, bought separately (clause 12). Other adapters aren't supported.
2. Files and tuning. You supply the files you flash, or get a tune from your tuner. Tuning is a separate service between you and your tuner, and you're responsible for the files and the service you choose.
3. Bench flashing. Bench flashing isn't offered or sold.
4. Results. No particular result, power figure, behaviour or outcome on any Vehicle is promised.

Compatibility

1. MQBone works with the controllers it supports. The compatibility section lists the families it programs. Your exact controller, its software version and your adapter decide what's available on your Vehicle.
2. You're responsible for confirming compatibility before you buy anything and before every Operation. Anything we tell you about compatibility is guidance based on the details you give us, not a guarantee.
3. Some features are new or experimental, and not every feature has been tested on every Vehicle, controller or software version.

Selling a Vehicle, or moving an activation

1. An activation is tied to a VIN. We can't promise that an activation can be moved to another Vehicle or another person. Ask support@mqb.au before you sell a Vehicle or buy another activation.
2. You're responsible for telling any buyer, insurer, financier or other person you're required to tell that a Vehicle has been modified, and for returning it to its original software where the law, a sale or an agreement requires it.

Buying MQBadapter

1. Ordering. MQBadapter is ordered through the Buy button on the MQBadapter page, which takes you to a checkout page run by Stripe. Placing an order is an offer to buy. A contract is formed only when we confirm your order by email or dispatch it.
2. Availability. MQBadapter is made in limited batches. We may decline or cancel an order, for example if it's out of stock, if a price or description was shown in error, or if we suspect fraud. If we cancel after you've paid, we'll refund what you paid in full.
3. Price and payment. The price, delivery charge and any GST or other tax are shown at checkout before you pay. Payment is taken by Stripe. We don't receive your full card details.
4. Delivery. We'll ship to the address you give at checkout. Delivery times are estimates, not guarantees. You're responsible for giving a complete and correct address and for being able to receive the parcel. If a parcel is returned because of an address error, we may charge for sending it again.
5. International orders. If we ship outside Australia, you're responsible for any import duties, taxes and customs charges, and for making sure MQBadapter can lawfully be imported and used where you are.
6. Risk and ownership. MQBadapter is at your risk from delivery. Ownership passes to you once we've received full payment.
7. Check it on arrival. You're responsible for checking MQBadapter when it arrives and telling us within 7 days if it's damaged, missing parts or not what you ordered. This doesn't limit your rights under clause 13.
8. Resale. MQBadapter is sold for use with MQBone. Don't resell it as new, or bundle it with your own products or services, without our written permission.

MQBadapter guarantees, faults and returns

1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
2. If something's wrong, email support@mqb.au with your order number and a description of the problem. We may ask for photos, a diagnostic trace from the app, or for you to send MQBadapter back so we can inspect it. Where you're entitled to a remedy, we'll repair, replace or refund it, or pay compensation, as the Australian Consumer Law requires.
3. Returns. Where we ask you to send MQBadapter back for a fault we're responsible for, we'll cover the reasonable cost of return postage. You're responsible for packing it safely and including everything we sent.
4. Change of mind. We don't offer refunds or exchanges if you simply change your mind, for example because you no longer need it or ordered the wrong product. This doesn't affect your rights under the Australian Consumer Law.
5. What isn't a fault. To the maximum extent permitted by law, we aren't responsible for problems caused by: damage after delivery, accidents, water or other liquids, impact or crushing; opening, modifying, repairing or rewiring MQBadapter; installing firmware not supplied by MQBau through MQBone; using it with anything other than a Vehicle's OBD-II port or a standard USB-C power supply; a Vehicle's own electrical fault; or normal wear and tear.
6. Your rights under the Australian Consumer Law, including the guarantees in clause 13.1, are in addition to any other rights you have.

Using MQBadapter safely

1. Installation is your responsibility. Plug MQBadapter only into a Vehicle's OBD-II diagnostic port, with the ignition off. Make sure it's fully seated and doesn't touch or interfere with the pedals, steering, your legs or any other control, and that it can't be knocked or caught while you drive or get in and out.
2. Battery. MQBadapter draws a small current from the Vehicle while it's plugged in, even with the car off. You're responsible for unplugging it if the Vehicle will be parked for a long time, and for the condition of the Vehicle's battery.
3. Don't use it if it's damaged. Stop using MQBadapter if its case is cracked, its plug or pins are damaged, it gets wet, it gets unusually hot, or it smells of burning. Unplug it and contact us.
4. Heat and environment. MQBadapter isn't waterproof. Keep it dry, and don't leave it exposed to direct sunlight, extreme heat or moisture for long periods.
5. Don't open or modify it. Opening the case, modifying the circuit board, or connecting anything other than the intended OBD-II port or a standard USB-C supply is at your own risk.
6. Firmware. Install firmware updates only through MQBone. Keep MQBadapter connected and powered until an update finishes. Interrupting an update, or installing firmware from anywhere else, may stop it working, and you're responsible for the result.
7. It's a tool, not a safety device. MQBadapter doesn't monitor or protect a Vehicle. Don't rely on it, or on anything it shows through MQBone, for safety.
8. Children. Keep MQBadapter out of reach of children. It contains small parts.
9. Your responsibility. Every Operation carried out through MQBadapter is covered by clauses 15 to 17, and the exclusions and indemnity in clauses 21 and 22 apply to MQBadapter as they do to the rest of MQBone.

Your responsibility for your Vehicle and every Operation

1. You use MQBone entirely at your own risk. You alone decide whether to carry out each Operation, and you alone are responsible for it and for everything that results from it.
2. Before an Operation, you're responsible for: confirming compatibility; backing up the controller and any module you'll change, where the app allows; a healthy battery, supported by a suitable battery charger or power supply for flashing; a stable adapter connection; the ignition and engine state the app asks for; and the Vehicle being stationary, parked safely and secured.
3. During an Operation, you're responsible for not interrupting power, the adapter or the app; keeping your device awake, charged and with MQBone open; not using or driving the Vehicle; and following every instruction and warning the app gives. See preparing to flash safely.
4. Files. You're solely responsible for every file you flash, including tunes from a tuner by PIN: that it's made for the right Vehicle, controller and software version; that it's safe; that it's lawful; and that you have the right to use it. MQBau doesn't check, test or approve files or tunes.
5. Coding, adaptations, basic settings and output tests can change how modules behave, operate motors, valves, lights and fans, and affect safety systems. You're responsible for keeping people clear of moving parts and for the result of every change.
6. Flashing and unlocking can fail and can leave a controller unusable or needing recovery. Recovery isn't available for every controller and isn't guaranteed. You're responsible for the cost of any recovery, repair, replacement, towing or dealer work.
7. After an Operation, you're responsible for checking that the Vehicle works correctly before you drive it, including warning lights, fault codes, brakes, steering, airbags and other safety systems.
8. Driving. Never let MQBone, CarPlay or Siri distract you while driving. You're responsible for complying with road rules about using devices in a vehicle.
9. Your accounts and devices. You're responsible for keeping your devices, Apple Account and MQBone account secure, and for everything done with them.
10. Information shown by MQBone, including live data, gauges, fault descriptions and Advanced Diagnostics data, may be incomplete, delayed or wrong. You're responsible for checking it before you rely on it.

Modifications and legal compliance

1. Every Modification is made by you, or on your instruction, and you're solely responsible for it, whoever supplied the file or carried out the work.
2. Legal compliance is your responsibility. A Modification may make a Vehicle unlawful to drive on public roads, or breach laws and standards on emissions, noise, safety, roadworthiness, vehicle standards (including the Australian Design Rules), registration and road use, in Australia or anywhere else. You're solely responsible for finding out and complying with every law that applies to your Vehicle and how you use it, and for any fine, penalty, defect notice, loss of registration or other consequence.
3. You must not use MQBone to remove, disable or tamper with any emissions control or safety system where that's unlawful.
4. Warranty, insurance and finance. A Modification may void or affect a manufacturer's, dealer's or extended warranty, affect your insurance cover, or breach a finance or lease agreement. You're responsible for checking, and for disclosing Modifications to your insurer and anyone else you're required to tell.
5. You're responsible for any Modification remaining on a Vehicle after you sell or hand it over.

High-risk and track-only features

1. Some features, including launch control, 2-step spark cut, rolling anti-lag, pops, gear-shift crackle and impulse combustion, raise exhaust temperatures and mechanical loads. They can damage the engine, turbocharger, exhaust, catalytic converter, clutch, gearbox and drivetrain, increase wear, and can cause fire.
2. Features marked "track only" are for use on closed circuits and private land, where lawful, and on vehicles set up for them. They must not be used on public roads.
3. You use these features entirely at your own risk, and you're solely responsible for any damage, fire, injury, loss or legal consequence.

Tuner PINs and the tuner portal

If you're flashing a tune from a PIN

1. A Tuner PIN works only on the VIN it was made for, needs that VIN's activation, and is claimed by the first MQBone account that enters it. It lasts 30 days and allows the number of flash attempts your tuner set. Once it has expired, been used up or been withdrawn, it can't be used again.
2. MQBau doesn't write, check, test or approve tunes. MQBone only delivers the file your tuner uploaded. You're responsible for choosing your tuner and choosing to flash their tune, and your arrangement with your tuner, including any payment, warranty or dispute, is between you and them.

If you're a tuner

1. Tuner accounts are approved by MQBau, and we may suspend or remove one at any time, for example if it's misused or these terms aren't followed.
2. You're solely responsible for every file you upload: that it's made for the right Vehicle and controller, that it's safe and lawful, and that you have the right to supply it.
3. You're responsible for having your client's permission to hold their name and VIN in the portal and to upload a tune for their Vehicle, for complying with privacy law in how you handle their information, and for your own agreements with your clients.
4. Don't share PINs with anyone other than the client they're for.

Other people's products and services

1. MQBone works alongside products and services MQBau doesn't control, including Apple's platforms and services, vehicle manufacturers' systems, tuners, file suppliers, workshops and the community Discord. MQBau isn't responsible for them, and your dealings with them are between you and them.
2. Posts and advice in the community come from other users, not MQBau. You're responsible for checking anything before you act on it.

No warranty

1. MQBone is provided "as is" and "as available".
2. To the maximum extent permitted by law, MQBau makes no promise, representation or warranty that MQBone will work with your Vehicle, that any Operation will succeed, that it will be free of errors, bugs or interruptions, that information it shows is accurate or complete, that it will be secure, or that it will suit any particular purpose.
3. To the maximum extent permitted by law, every warranty, condition and guarantee that would otherwise be implied by law, statute, custom or otherwise is excluded.

Exclusion and limitation of MQBau's liability

1. To the maximum extent permitted by law, MQBau isn't liable to you or anyone else for any loss, damage, cost, expense, claim or liability of any kind, however it arises, including in contract, in tort (including negligence), under statute or otherwise, arising from or connected with:
   1. Modifications: any Modification, including files, tunes, Tuner PIN flashes, ECU unlocking, coding, adaptations, basic settings and MQBpatch features, whoever supplied or carried them out;
   2. Damage to Vehicles: damage to, or failure of, any Vehicle or part of it, including engines, gearboxes, turbochargers, exhausts, catalytic converters, controllers and electrical systems, any controller left unusable or needing recovery, and the cost of recovery, repair, replacement, towing or dealer work;
   3. Legal compliance: whether a Vehicle, Modification or feature is lawful, including emissions, noise, safety, roadworthiness, vehicle standards, registration and road use, and any fine, penalty, defect notice or loss of registration;
   4. Warranty, insurance and finance: any effect on a warranty, insurance policy or finance or lease agreement, including a refused claim;
   5. Use of the Vehicle: how a Vehicle is driven or used, including accidents, fire, injury, death, and use of launch control, 2-step, anti-lag, pops, crackle, CarPlay, Siri or the app while driving;
   6. Data: loss or corruption of Vehicle data, coding, calibrations, logs, settings or other data;
   7. Third parties: the acts, omissions, products, files or services of anyone else, including tuners, file suppliers, workshops and Apple;
   8. MQBadapter: to the extent the law allows, battery drain while it's plugged in, its position interfering with a Vehicle's controls, damage while installing or removing it, interaction with a Vehicle's electrical systems, and anything caused by opening or modifying it or by firmware not supplied through MQBone;
   9. Availability: MQBone, its online services or any feature being unavailable, interrupted, changed or withdrawn; and
   10. Indirect loss: loss of use of a Vehicle, lost time, lost income or profit, lost opportunity, damage to reputation, or any indirect, special or consequential loss.
2. Where the law lets us limit our liability rather than exclude it, our total liability for all claims together is limited, at our option: for services, to supplying them again, paying the cost of having them supplied again, or refunding the amount you paid for the activation, or for the current period of the Subscription, concerned; and for MQBadapter, to replacing or repairing it, paying the cost of doing so, or refunding what you paid for it.
3. Each paragraph of this clause is separate, and applies even if MQBau was told a loss was possible.
4. This clause applies subject only to your consumer rights in clause 23.

Your indemnity to MQBau

1. To the maximum extent permitted by law, you indemnify MQBau, and keep MQBau indemnified, against every claim, demand, action, loss, damage, liability, fine, penalty, cost and expense (including reasonable legal costs) that MQBau suffers or incurs arising from or connected with:
   1. your use or misuse of MQBone;
   2. any Operation or Modification carried out by you, on your instruction, or with your device or account;
   3. your breach of these terms;
   4. your breach of any law, including laws on roads, emissions, noise, vehicle standards, registration and privacy;
   5. any claim by anyone else, including a Vehicle's owner, buyer, passenger, other road users, an insurer, financier, manufacturer, dealer, regulator or your clients, relating to a Vehicle you used MQBone on, or its Modification or use;
   6. your installation, use, modification, repair or resale of MQBadapter, or installing firmware on it that MQBau didn't supply;
   7. if you're a tuner, any file you upload or supply and your dealings with your clients; and
   8. any negligent, wrongful or unlawful act or omission by you or anyone using MQBone through you.
2. "Indemnify" means you'll compensate MQBau for those amounts and, if we ask, take on the defence of the claim at your cost, with our cooperation.
3. Your liability under this clause is reduced only to the extent that the loss was caused by MQBau's own negligence or breach of these terms.
4. This indemnity continues after you stop using MQBone or delete your account.

Your consumer rights

1. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (including its consumer guarantees), or under any other law that can't be excluded by agreement. Every exclusion, limitation and indemnity in these terms applies only to the extent the law allows.
2. Those rights stand on their own. They aren't replaced by Apple's refund process, and Apple declining a refund doesn't remove them.
3. The ACCC publishes an overview of consumer rights and guarantees: accc.gov.au.

What you must not do

1. You must not use MQBone:
   1. on a Vehicle without its owner's authority;
   2. for any unlawful purpose, including unlawful tampering with emissions or safety systems;
   3. to bypass activation, share activations or resell access;
   4. to copy, clone, reverse engineer, redistribute or interfere with MQBone, MQBpatch, MQBadapter or its firmware, or our services; or
   5. in a way that could harm people, property, other users or our systems.
2. You're responsible for any consequence of doing so, as set out in clause 22.

Suspension and termination

1. We may suspend or end your access to MQBone, or any part of it, if you breach these terms, if the law requires it, or to protect people, Vehicles, other users or our systems.
2. You can stop using MQBone at any time by deleting the app and, if you want, your account.
3. Clauses 12 to 24 and 28, and any other clause that by its nature should, continue after these terms end.

Availability and changes to MQBone

1. MQBone is still in development, and features may be changed, suspended or withdrawn. Some features need an internet connection, such as checking your account and activation before an Operation, Advanced Diagnostics and Tuner PINs. Uninterrupted availability isn't promised.
2. What you bought is recorded by your MQBone account and by Apple. If an activation looks wrong in the app, use Restore Purchases, then email support@mqb.au if it's still wrong.
3. How we handle your information is set out in the privacy notice.

Changes to these terms

1. We may change these terms at any time by publishing the new version on this page with a new date. The version in force when you use MQBone applies to that use.
2. It's your responsibility to check these terms from time to time. If you don't agree to a change, stop using MQBone.

General

1. Governing law. These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that can hear appeals from them, and the Federal Court of Australia.
2. Severability. If any part of these terms is invalid or unenforceable, it's read down to the extent needed to make it valid, or severed if it can't be, and the rest of these terms continue in full force.
3. No waiver. If we don't enforce a term straight away, we can still enforce it later.
4. Entire agreement. These terms, together with the privacy notice, are the whole agreement between you and MQBau about MQBone.
5. Assignment. You can't transfer your rights under these terms. We may transfer ours, for example if the business is sold.
